Is it legal for a non-union snack food manufacturer to do an employee Pocket Search? There was an unannounced Pocket Search done at the Connecticut manufacturing facility where my friend's husband works. Two supervisors went up to one employee at a time and asked them to empty their pockets. The employees had to turn their pockets inside out to show if they had anything in them such as change, which they are not supposed to be carrying while they are working their shift. Is this type of search legal?
Is it legal to search someone at a private school? I go to a private school and this year they have come up with a new "rule" to keep kids from texting in class. You have to put your cell phone in a box before every class then after class you can get it back. To make sure people don't just hide their cell phone they will be conducting random searches of you bookbags/pockets ect. It doesn't seem like it would be legal to search someone just looking for a cell phone, I understand for drugs or something but this just doesn't seem legal.

Would this be considered a legal search in the state of Texas with reason to arrest? Police officer knocks on the door of the suspects apartment, informs the suspect that he has deteremined that the odor of burning marijuana is coming from that apartment. Officer asks the suspect "do you mind if i look around?". Suspect says "yes". Officer says "says you mind or yes i can?". Suspect says "yes" without a chance to continue before the officer is inside the apartment. The officer then kicks the coffee table over to expose an ashtray with a marijuana roach and a search of the apartment insues in which a bag of marijuana is found under a mattress. The suspect is then questioned about where the marijuana was bought at and the location of anything else in the apartment. Suspect is then read their miranda rights and is asked to repeat what was just said into a tape recorder on scene. I'm working on a case scenario for a criminal justice intro class and I am quite confused by the scenario and the stipulations of searching an apartment without a warrant. There was nothing illegal in plain site, the term "search" was never used, only "look". Nothing was discovered untill the officer kicked the table out of the way after seeing nothing was in the open. This is a domicile, not a vehicle, i know consent to search is not needed for a vehicle ,due to its mobailty, but is needed to search a home with no warrant.

I was coming home from my work and I forgot my wallet at home. I gave the cop my insurance and registration and i told him i didn't have my license on me he searched me and my car. He didn't ask to search my car he just put me in the back of the cop car and searched it. I didn't have anything to hide in the car. I just to know if he did the same to someone else and found something would it be illegal
I was searched downtown with a group of people, was the search legal? I was standing around with a friend of mine downtown in an alley. Its a popular alley because it's legal to spraypaint there. There were 6 or 7 people around me. One or two of them were drunk, and one guy had a knife out. There was an open beer bottle on the garbage can a few feet away. The cop walked up, ran background checks and then searched everyone. I am 17 and they found weed on me, wondering if I can get out of the charges because of an illegal search. Im in washington state.
Is it legal to physically search employees? Today we were told that we would now have our purses, coats & pockets & our person searched upon leaving the store. We were also told that someone from corporate could be waiting outside in the parking lot to search us.Our coats & purses are locked up from the time we get there until we leave. I was searched right at the front counter in front of co-workers & customers. Is this legal?
Is this a legal search and seizure? This is the situation: A search warrant has been executed on a specific property. An officer who is part of the search warrant team walks off the property into the city street and flags down an oncoming vehicle. The vehicle stops and the officer asks the driver and passenger of the vehicle for their identification. A minute later the driver asks the officer's if they can pull their vehicle over so it's not idling or blocking traffic. The officer consents and the driver sees no where safe or legal to park except the near by driveway. Upon pulling into this driveway the driver is told by the officer that their vehicle will now be searched because they chose of their own free will to park on the property where a search warrant is being executed and the warrant says "All vehicles on property". Is this a legal?
Is it legal to search someone like this in the parking lot with no privacy? Alright, I was watching some cop show, and I guess they saw her stick drugs up her crotch. A woman police officer was called to the scene, and put her hands up the woman's skirt, and pulled out the drugs. No privacy whatsoever. Then she saw her sneak another bag right into her butt, so she threw her to the ground, and went out of her way to make sure people saw what was going on. Is this at all legal? Just curious!
Is it legal to search primary students' school bags? My 6th grader came home today saying that two students had had something stolen from their desks overnight. Teacher told the students that if these items were returned by the end of lunch time there'd be no punishment. When neither item was returned, a bag check ensued, which didn't identify the guilty party/ies. Tomorrow there's going to be a tidy-tray (desk) check and a note is going home with each student asking parents to check their child's room. Does anyone else think this is a bit of over-kill? Is it in fact legal to be searching students' belongings like this? (I know we've got nothing to worry about of course!, but it's the principle of the thing)
Is it legal to search a person without probable cause? During a festival where more than 3000 people are present, a friend of mine was randomly selected out of a crowd and questioned. Was asked his age, then asked what purpose was for being there, was then asked if anything illegal was in pockets. Just based on appearance. when he replied "nothing" he was then turned around told to put hands up on wall and was then patted down. Is this legal?
Why do cops feel that it is legal to search a vehicle without a warrant? Earlier today I was pulled over for a burned out taillight and the officer tried to search my car. Obviously I refused. He proceeded to try and threaten me but he eventually backed down. Is this not the United States of America? Also what kind of cop would you have to be to search someone without probable cause? Response to this answer: "we have cops at our school all the time and they said they cann't search a car without a warrant and if they try to search it you have the right to say no you can't search the car but thats where i live i don't know about there" Thats what I'm getting at, they do not have that right but they try to bully you into it. Any state that makes this legal is violating the US Constitution. Cali Cop, your breaking the law when you do that. Any smart person could win there case against you for that. ambr123, If you know the law instead of taking someone's word for it, you would know that is false. A warrant is definately needed. Cops don't get them because they can bully most people, because most people are kiss asses when they get pulled over. Anyone who plays the "what do you have to hide card" obviously doesn't care about their constitutional rights. If you don't fight for your rights you will lose them. If I had an open container and was rolling smoke like cheech and chong then I can see their reasoning, but I was wearing a buisness suit on my way to work! If I just go ahead and let them search my car, how does that look when I'm late for work. "I got pulled over and they searched my car for drugs."

Does this sound like a legal search and seize ? Heres the situation, the police respond to a domestic disturbance, a couple somewhat prone to such conflict. And during a search of their apartment find three marijuana joints in the husbands pants pocket. They reside in Arizona and he is looking at three years, apparently hes had afew non violent drug related convictions in California. Does this sound a bit extreme. And why were the police searching a pair of pants that were'nt even being worn ? Bear in mind this is intially a domestic dispute. Any info on this search and sentence length ??

Is it legal for an employer to search your purse? I am a cashier at a retail store in Ohio (the kind where everything is just $1) and the District manager has now informed us that we have to have our purses searched every night and if we do not want to have them searched we are not to bring them into the store. I carry personal things in my purse that I need along with medication that I may need in a hurry ( for severe asthma attacks) and I wouldn't like my things gone through on a nightly basis. We have a locker area where I lock my purse up (with a lock I paid for) when I get in and then only remove it when on break or leaving. I work in the front of the store and the locker area is in the rear of the store. Male employees have not been asked to turn out their pockets, is this fair or legal?
Is it ok/legal to search someone who is coming into your home? My teenage daughter is having a party. We know everyone she has invited, but if someone brings a guest we don't know and we are "nervous" about, do we have the right to ask guests to empty their pockets, etc. before they enter? Or would it be better to simply refuse someone entry?
Is it legal to search through a person's trash once they have thrown it away? The apartment managers at my complex are searching thru trash bags that were not thrown IN the bins (they were sitting outside the bins and the bins were completely empty. People are lazy and dont want to take the time to open the bins to put the trash in there) so they can send them a warning letter, and/or fine. Is that legal in California? TOWANDA: youre an idiot. Im NOT the lazy person, I ALWAYS THROW MY TRASH IN THE BINS, SO SHUT THE HELL UP. HOW DARE YOU!! TOWANDA: youre an idiot. Im NOT the lazy person, I ALWAYS THROW MY TRASH IN THE BINS, SO BITE ME! For anyone that is curious, I am asking because I am curious so that if I see , ppl being lazy, I can warn them as well that their trash WILL be looked through if they dont follow rules and put it in the bin like they are supposed to.
Is it legal for employers to search their employees personal belongings? I know that employers have the right to search, but only under certain conditions. I was under the impression that they were only allowed to search if they had cause. They aren't allowed to search systematicaly, every person, in front of all the employees. And they aren't allowed to terminate the employee on the spot if they find merchandise that mihgt not have been paid for or other materials that might conflict with their policies. I know that companies are allowed to search if it is for security purposes, but isn't it taking it too far when they're checking and employee's bag every time they leave the store? Keep in mind that this store is in a mall, and has no bathroom of it's own. The employee has to leave the store to use a restroom. I just want to know where the boundary lines a drawn and what exactly the employer can and cannot do. And if the employee's rights have been violated, what can the employee do about it? Another question I have to go with this is, does there have to be an officer present? I was also told that ONLY law enforcement officers can LEGALLY search any person. And an employer must have an officer present at any and all searchs conducted. Is this true?
Would the police have a legal right to search my car in this situation? If my car were parked in a parking lot of some sort, and someone of a private domain witnessed me putting illegal drugs in the trunk of my car and then calls the police on me after I have closed the trunk, would the police have a lawful right to search my car when they arrive, even if the police saw nothing?
Is this police search and seizure legal and admissable? The police have a search warrant for items specifically about " John" no one else, but while searching the house they remove a DVD with the name "Frank" clearly written on the box of the DVD. it is legal for employers to search facebook for potential job applicants ? With all of the information available on the world wide web, is it an ethical action for employers to search public cites like MySpace and Facebook when researching potential job applicants? Should what people do in their free time, and what happens on the weekend or after hours a contributing factor to the hiring process? is this a legal search and arrest by cops? i know someone who went and bought drugs out of town. he came back and once he got back into his town he stopped at a store and parked in the parking lot and when he went to get out to go into the store cops took him out of the car and found the drugs in the car and arrested him and the passenger. what probable cause do these cops have if the purchase of drugs was out of town and the cops were from his hometown, not the town he bought the drugs in?

Is it legal for employers to RANDOMLY search employee purses, briefcases, etc? Last week my employer sent around a memo that is supposed to be revised, but currently states that they "reserve the right to examine all packages, handbags, or brief cases in possession of any associates entering or leaving the property". This has everyone infuriated, and wondering about the legality. The search is supposed to be random, meaning they would not have probable cause or anything. I know that stores cannot search personal articles, law enforcement must be present, is it the same for employers? I don't know if it makes a difference but I am in WI.
Is it legal to search through someones mail or discuss peoples mail with the mail man? I have a two bedroom apt. My brother has recently moved into my second bedroom. He has mail sent here now. Recently my apt. manager has sent me a letter inquiring who (my brothers name) is and why he is receiving mail in my mail box. It further states to remind me that I am the only one who can receive mail here. I did not have my brother sign into the lease and so I am sure that she is right in saying that I am the only one that can receive mail. But I wonder how she came to know that he was receiving mail in my box. There are only two things I can think of, either she looked in my mail box or she was told so by the mail man. Now a neighbor said her and the mail man were friends so it is possible. Given this, does she have even have the right to ask me this if the two ways I stated above are illegal?
is it legal for a store manager to search my pockets and pat me down as if her were a police officer? i recently stole a pair of 270 dollar sunglasses then was caught. Is it legal for colleges and universities to search dorms for items against policy, and then take them? Recently at my college, the housing department rehearsed a fire drill as they do from time to time throughout the dorms. However, this time, the housing staff went from room to room, checking for extension cords (which are against housing policy), alcohol, and other prohibited items. Perhaps this is legal, I'm not a lawyer, and it is their property, I guess. The thing that seemed wrong, though, was that upon finding any of these items, they were taken, with no note, verbal explanation, or anything. Isn't there a law somewhere that protects me from my college taking my stuff? Even if it is against policy, isn't this taking it too far? I'm not looking to press charges, or really make any legal action whatsoever. However, having some link to a law or ordinance that protects my rights would be helpful. Or is the college at no fault whatsoever? Thanks to anyone who can offer help.
Searching for legal advice about work place harassment? I have worked for a company for 6+ yrs and have had outstanding reviews. I recently transferred into a new position (that I had to fight to get) and the boss hates me. Long story short, she never wanted me in her department and is riding me daily and has threatened to terminate my employment. All legal searches regarding harassment state sexual, age, gender, disability. Is there any legal backing for just being treated unfairly and threatened?
was this a legal search and seizure? Ive had been bringing a pocket knife to school for about 2 years and no one has said anything. i never planed on hurting anyone. its just nice to have around. Its very useful. i use it to shave reeds (clarinet, sax) and ive never gotten in trouble in school before. when i was getting a bag of chips at the vending machine one of the security officers asked me what was in my pocket and i told him it was nothing. and he made a big deal about it. and i said its a pen (it really does look like one of those fat pens) and he was like let me see it. and i stated that he had no reasonable cause to ask for it and get it...and long story short i got suspended. like i said, im a good kid when it comes to this sort of thing. was this a legal search and seizure? i live in the state of Maryland excuse me, but the real jerk is the security guard. he does nothing, people are getting high in the back of the school and selling drugs in the bathroom, and most of the security goes after the kid sitting in front of the school doing their homework because theyre 'not where theyre suppose to be' the security in my school does not make me feel secure at all
Legal search by police? Is it a legal search if I have been cited for a minor traffic violation and the police ask for permission to search me and my vehicle. I refuse and they call a police dog to sniff around my car.
Is it legal for a male police to search a female? I was a passenger in a car when it got pulled over. The officier didn't give a reason for pulling us over, but asked to search the car. When nothing was found in the car the officier told the driver, a male, and I to get out and put our hands on the hood, then he searched us. Later the officier told me i was being charged for riding with no seatbelt, which i had been wearing, and that I had old warrents for traffic violations, so i would have to be taken in. Also he told me the riding with no seat belt would get thrown out of court so I shouldn't worry about it. The driver of the car only recieved a ticket because he had just moved to a different apartment and hadn't change his old address on his license.again he was told that it would probably get thrown out of court by the officier.
is it legal for a male officer to search a minor girl? my daughter and some of her friends were walking down the street when our town's officer stopped them and frisked them. I would like to know if this is legal, she is a minor and has never been in trouble with the law.
