Dr. Phil .com I need some legal advice refarding child support and custody issues and I can't find any help. Dr. Phil I am a single mother of 4 young children my older boys are twins are diagnosed with ADHD I was in an abusive relationship with their father I put an order of protection on him because he threatened our life I had him arrested he was in lockup for co2 days and he was told not to come any where near us. We went to court and we first tried suppervised visits that did not work out he said that he had to many things on his plate to do the visits with the children. next we went back to court and we agreeded on joint legal custody it was working for a while until he started bringing his girlfriend around and the kid s dislike her and she says derrogatory towards and he ignors it when they tell him what she says to them. I don't get any child support from him he says he quit his job so i don't get any money him he doesn't come and come willingly and give me any money for them i am desperately in need of legal service and support . don't have alot of money i just need some help.

Where can first response city workers who have health problems resulting from 9/11 seek legal aid? E.g. If a fire fighter or police officer suffers from resperatory problems after being stationed at ground zero immediately after the attacks and is not getting the support and medical services required through their employer-- are there any organizations or legal aid societies with available resources?

Supplemental services for Special education Speech , OT, APE? After 2 1/2 very unsuccessful years of the local school district instructing my special needs child (Autism) and her failing to meet her educational goals, I have decided to not waste anymore time and Homeschool her myself. The down side is that I am being told that if she does not attend their school I will lose all her support services (speech, OT APE) First question is that legal under FAPE? Second question does anyone know of some good materials that I could use to get her services in the above areas I cannot afford private therapy. Moreover, feel stuck....? She is a bright child but needs to be taught to her needs and her method of learning not theirs....

child support legal advice please!!!!!!!? in the state of texas, can the attorney generals office increase child support payments based on pay without notifying you? my husband makes considerably more than he did 8 years ago when he first started paying child support and now his pay is being reviewed. we havent even started having a family and are trying to save for that, and now we might not be able to because double the money might be taken out. is that fair? his ex is on her 7th child and she gets all kinds of govt assistance and we never have, and now we might have to feed her all her kids? this is wrong and an injustice! we are hardworking medical professionals, what legal rights do we have? he has only one child who is now 11 with his ex. and she never even sends any clothes anytime the child comes, so we end up buying a whole wardrobe every summer and christmas, and pay for all the plane ticket when the ex is supposed to pay half. and we had to buy the child a cell phone bec, she couldn afford to have phone service! i am very upset and need some help, fast! the ex is saying she didnt provoke the att. gen office to increase payments and doesnt want anymore money, but i don't buy it. if she is telling the truth, can some kind of agreement be reached so that we dont have to pay much more?

Child Support Question (California)? I have some child support questions. First of all I’m located in California, I have a 17 year old junior in high school and I make $100,000.00 a year. I’m guessing baby mama is on public assistance. A little background I was divorce back 1994 at that time I was awarded 50% joint and legal custody with 50/50 visitation. My child support at that time was $175.00 a month and we were to split the healthcare and child support costs 50/50. I’ve paid her on time and have even increased her support over the years and have taken care of all my daughter medical expense. I did this on my own and we’ve have never been back to court. The support was ordered in our divorce paper but never through child support services. Now fast forward to last year. I’ve continued to pay her $350.00 a month and kept up all the medical and the majority of all my daughter’s expense though November of last year. Even though my daughter would only stay at her mother’s house a couple days a month. In early November my ex took off with her boyfriend and left the state. I have not paid her since her absence. I honestly don’t know where she is, so I couldn’t send her a check if I wanted to. She has not seen my daughter in that time. We’ll I was just served with papers from Child Support Services asking for a complete financial statement for child support requested by her mother. Here are the questions I have. 1.Can she file and get the last 6 month of support even though she was out of state and has made no contact? 2.Does she have any legal right to get support from me, even though I’m paying all my daughter’s expenses anyways? 3.Can she do this filing within our county from another state? 4.Can she be in legal trouble for this? 5.Is it possible that’s she’s collecting a fraudulent financial aid for my daughter and a government agency has filed for her? 6.Wouldn’t she need to provide the Child Services all my personal information (address and social security number)? 7.Can my daughter legally decide if she even wants to spend time with her mother? (they’ve had a strained relationship for years) I’m just confused. I’m just trying to do the right thing. I have an appointment with Child Support Services in a week and I plan to file the paperwork to indicate my daughter lives with me full time. This just sucks that the mother could abandoned her own child and goes after the father for support. Has anyone been through this before?

Is collecting child support a waste, and gone too far? I read a new report by a independent organization. It said that the money that the States get from the federal government to collect child support is being wasted. the pointed out that the money they actual try to collect for actual court ordered support is being collected properly and is increasing due to more population and more divorces and single mothers. They said that the money that is not collected in interest fees. This is something most people do not understand and don't even know exists. It is not actual support. It is a 10% fee that is added to child support over the life of the order and then after the order. The problem is that the states want more money because they have designed a business with employees and pensions and health care, that depend on there jobs working for the child support services department. If they only collect the actual child support they will have to lay-off employees. In affect, the child support system has gotten so big and so many people are now defendant on it, that if it cuts back and just collects support, it will be hard on the people it employees. haha. It makes me laugh. The report says, in order for the government to cut costs and reduce the national debt. It should not try to collect child support interest. Which, is not the intended purpose of the system in the first place. The report also says, that the debt will only get worse and more money will not solve the problem because 96% of all child support orders are being paid as agreed. They also say that it will never be paid off because the average mother in the 10 year study of the report, has shown a 98% chance to have another child and children and become dependent on the child support system again with in 5 to 7 years after separation of the first father or legal parent. The report also says, that the non-custodial parent or father is likely to have a 25% chance of fathering and using the child support system with in 5 to 7 years after separation and order for support. So lets get this straight, the fathers are not more likely to go get women pregnant and pay to the system again because of the strict, strong arm tactics. In other words, the women will keep on having kids from multiple guys if they know that they will always get child support. So there is no discouragement for women to use the system. They will keep have kids and divorcing men perpetually, if they now the government will collect the child support. It gives them mothers no incentive to keep their marriage together in the first place. The study said, that they interviewed 15,000 single mothers and when asked, why they filed for divorced or separated from their partners they said, it was money matters, and personality differences. haha! I am laughing, so lets get this straight, they separate the family because of money matters or struggling with money, yet they jump into more struggling over money, on purpose and become a single mother? hmm.. The report also stated that the system is the new, "welfare for single mothers". And is costing the tax payers more money than the current system of welfare, which it was supposed to alleviate. State laws and mandated by federal laws, in this case child support. the study shows the circumstances for the interest charges. one is the time lasped in the order from court to father. It is understood that this time is retoactive and is a period of 6 months to two years. which means from the time the father gets the court order his is already in the hole and collecting interest. second this is made worse because the DA puts this adverse information on his credit report, so if he wanted to get a loan to catchup, haha, no one will give him the loan. And it is a fee, that should not exist in the first place. Your kids is not a loan or a credit card. but to you ellie, who is a scorn women, it is justifiable payback! for a lost marriage, right!!! errhhh!! ok ladies, since you all want to whine and tell me your sad story and avoid the question and the real reason I asked it, and think I am here to hurt you. I will say this. I have personality paid over $90,000 in child support and interest. I had to struggle as an artist for many many years. It was hard on me and my ex. but,this is the chance we both took when we fell in love and then out of love, This is life. I cannot tell how many times, I eat top roman and canned beans, while they took half my part time job paycheck. I went to college during the day and work 12 hours at the gray yard shift. I slept about 4 to 5 hours a day. I slept on a mattress on the floor in a rented room. I had my crazy roommates stealing my stuff and fighting with each other daily. But, I had to do what I wanted with my education and goals. I drove a 10 year old car that kept breaking down and never bought new clothes. I let them take half my paycheck, and did not go to court to petition a reduction that I go have. I just eat the beans and went to work and school, because I knew my ex needed the money. I found a way to go out on top. as a matter of fact, I would not have it any other way. I learned to resourceful and to make the best of things. I deal with difficult situations in ease. I paid and I paid. But I will not pay any more than what I agreed. I will not give away my money for nothing. I do not mind paying support, but when the government adds fees and starts a system of kickbacks and so on. I will not buy that. I will not play that game. For added value, when I became more successful with my education and skills, I paid lump sum of cash, $4,000 here, $6,000 her and when I went to pick up my kid. guess what I saw? a new 52 inch t.v, a new purse that was expensive..and so on, I was giving mony when I found out the mother was addicted to drugs, and yes guess where the money went. then I got the kid in a rush. then the kid was taken away when the mother stopped the drugs. and all the time I had to pay. But, see there are two side to the story, and again, it is not about my personal story or yours. It is not about actual support. it is about the system that is not working and making fathers pay fees that are not fair, and are above and beyond support.

Georgia child support recovery has called a contempt hearing, what does this legal stuff mean? My husband has custody of his son. The mom is suppose to pay child support but she doesn't. The state of georgia, child support recovery, has scheduled a contempt hearing for 3/18 because she doesn't pay support. The website said at first the "SERVICE CAME BACK DILIGENT, WILL DO A QUICK LOCATE~TO ATTEMPT SERVICE AT NEW ADDRESS IF ONE FOUND. PER SHERIFF?S OFFICE HOUSE VACANT" So we of course reported her current address. Then 2 weeks later the site said "CERTIFICATE OF SERVICE AND NOTICE OF HEARING FOR CP TO CLERKS OFFICE FOR FILING AND CP. NISI MAILED TO NCP. I know my husband is the CP (Custodial Parent) and that she is the NCP (Non-custodial parent) but does this mean that they finally served her? Last time they did this she had gotten served by certified letter but she didn't show up so they issued a warrant, but we heard a lot of other names that day that there was no service, they didn't reach that parent. My step-son has told us of a new game they have at his mom's house where they hide and turn off the TV if anyone knocks at the door. We don't want to take off work if they didn't actually get a hold of her. Does all this jargon mean they DID serve her? What would it matter if we didn't show...the contempt charge has been brought by the state, we aren't even allowed to speak, why would it look bad if we weren't there?

I was paying child support, now I have custody, my ex-wife's is now the one paying child support.? she has now raised in court that I was not paying her the full amount since 1995. Therefore asking relief of her child support payments. I've paid her every month since originally ordered, but do not have all the canceled checks, money orders on record. Is it her duty to supply proof that I did not pay her like she claims? What can I do to show proof that I did make the payments & also made additonal cash payments to her? This the first time she has raised the issued and if she had problems with the child support then why didn't she asked for help ie Child support services, DA? How long can they go back if child support was not an issue then until now since she's the one paying me child support? Does she have any legal recourse for raising the issue now? We also had a verbal agreement that part of my child support I was to give to her be held in mutual funds for our son's college, in which I've contributed to since the agreement...

Child Support in Alabama ex is self employed, and I got served papers yesterday wanting to reduce? I know the first thing everyone is going to say is consult lawyer, Well I dont have money and made appointment with legal services as soon as I got served, I just wanted some ideas, Ex owns his own business, I know for a fact he does not report nearly half of what he takes in, he all of a sudden says his business has slowed down and wants reduced, He filed original papers july 2005 and I never got served and now they want it retroactive when papers filed, the orginal papers said I was harrassing him nothing about child support. Restraining order? A friend of ours has restraining order filed against him in NC. He was released from the psych unit on Thursday. This is his first time and there was no Physical violence involved. Are there any free legal and support services that is available to him? Dose he need a lawyer? How much will it cost him? What is the best way to resolve this? Thanks H1

Is that the fault of white America or, first and foremost, a failure of the black community itself? As for racism, its ugliest manifestation is in interracial crime, and especially in terracial crimes of violence. Is Barack Obama aware that while white criminals choose black victims 3 percent of the time, black criminals choose white victims 45 percent of the time? What type of legal documentation do I need to ensure compensation at the end of a technician service order? I'm getting ready to start taking technical support service calls on computer equipment on-site as a full-time consultant for an home-based business that I am developing. The labor rate is going to be $20 per hour for residential and $40 per hour for business on top of a travel rate of $0.75 per mile for residential and $1.00 per mile for business. So basically what I want to do is: 1. transfer the legal right of possession of the equipment to my company on-site, or stop and bill for travel 2. waive the liability of data loss / loss of limited manufacturer warranty for certain procedures on-site, or stop and bill for travel 3. start and finish work on-site, or stop and bill for partial work and travel 4. receive compensation on-site, or stop and bill for work and travel and leave with held equipment, then bill for holding equipment off-site at a rate of $5 per day beginning the first day after invoice date (all of which will be required to release equipment back to customer) 5. transfer the legal right of possession of the equipment back to the customer on-site, and smile a little knowing most people follow the rules and I have little to worry about Also, I want to document it in a single section of a 1-page form, which contains lots of information fields already, however, I am willing to use a 2-page form by printing on both sides of the page. This single purpose form should permit me to document the customer info, service order info, data loss liability waiver, manufacturer warranty liability waiver, backup/restore information, operating system installation information, hardware modification information, and probably more than that as needed. Basically I want to be able to pull a file and know what myself or another technician has done, and to do that requires lots of check boxes and empty blanks to fill in. So I don't have a lot of "legal room" to work with, but, with the correct font size, margins, paragraph settings I should be able to fit in quite a bit if need be. Can I have monthly arrears payments, for children over 19yrs old be reduced to benifit a child under 18? Facts: Paying arrears for Two children by my first wife. Both now over 19 years old, none in college etc. One child, 10yrs old from recent marriage. Two different states. My cost of living has gone up due to the pending divorce, separate housing etc. There is no more that I have $$ that can go to the 10 year old for child support. Fist ex is in much better financial place then ex #2, if that matters. Is it true that the 'total amount' owed in arrears is permanent? The bigger question is; I want to know if I can have the monthly arrears 'payments' reduced to help pay child support for the 10 year old child of my recent marriage? Do I go to the state where the original order is from and apply for a reassessment of arrears? Or What? Is there a dept in state gov or legal service that can help me for little or no cost? Going into debt each month due to the arrears. Thank you

My fiance is getting transferred out of state. Am I going to be able to take my son with me? I live in California with my 8 1/2 year old son and my fiance. My fiance's company just transferred him to Wisconsin. I obviously plan on moving with him and I want to take my son with me but there is a bit of a problem, his father (me ex) doesn't want me to take him out of state and says he will fight me on it. When my son was 5 months old (2002), I got a lawyer and we went to court to get our parenting agreement in writing so not to confuse the child. We agreed on 50/50 visitation, and joint physical and joint legal custody. He did not have to pay child support. Everything was going fine until 2004 when he just up and disappeared. I had no number or address for him, until April 2005, when I took him to court. This time, I had to represent myself because I could not afford an attorney. In mediation, we agreed that he would have supervised visitation for 3 months and he would pay me child support. When we went to court, the judge ordered the visitations and that he pay me child support directly. I saw the father the day after court so he could pay me the first child support payment, but I did not see him again until May 2006. I had contacted Child Support Services and ended up having them have his wages garnished for the child support. When he came back, I was probably way too nice about the situation and I let him start seeing my son again. I allowed him to come to our house for dinner and take my son to ice cream and various things. I finally ended up allowing him to have him on the weekends. He has now been going to his fathers every weekend, but my son sees it as "play time" because his father isn't much of a disciplinarian. His father just moved into an 2 bedroom apartment 6 months ago, which he shares with me sons grandfather. My son does not have his own room or even his own bed there. His father does not come to any school functions, parent teacher conferences, or Dr's appointments. He was however, very involved with his football season this year. My son also goes to a private school, which I was the one who got him into. I have been unemployed for the past year, but my fiance and I have been able to keep my son in his expensive school. I also take care of the costs of all of the school uniforms and any daycare and volunteering at his school that is required. Until I got laid off in June, I was the one who supplied the insurance for him. His father now has him covered through his insurance. His father is also a bit of a flake with the whole dropping off/picking up thing. He is constantly late on Sundays, dropping our son off way past his bed time. He also never contacts me about when I need to drop him off, or pick him up, or if he is gonna take care of it and he takes forever to get back to me when I call or text to find out what is going on. I talked to his father a couple days ago about our move. My fiance couldnt possibly turn down his job in this economy because he is the primary breadwinner in the home. His father says he is gonna fight me on this because he belives this will be bad for our son. I let him know that I am not looking for an increase in child support and that I am willing to pay the travel costs to fly my son out to see him. I am willing to allow him to stay with him on all of my sons vacations (summer, Thanksgiving, Easter...) and I have even arranged so my mother will care for my son while his father is at work and he is out here. We want to be able to make this transition as easy as possible for everyone involved. My fiance and I are even willing to pay for his father to come out and allow him to stay with us so that my son is able to see his father every 6-8 weeks. No where in my court documents says that the original joint custody was changed, but I have been the primary caregiver for my sons entire life. I have an appointment with an attorney in a couple days, but I am VERY worried. Am I gonna be able to bring my son with me?

Hi this is basically what has happended when I bought IT courses through Mindleader in Ireland any help with legal actions etc will be appreciated On the 30/11/2009 I purchased the following courses from Mindleaders/seller  COMPTIA A+ Essentials 220- 601  COMPTIA A+ Technician 220 – 602  CCNA 640 – 801  CCNA 640 – 802  MCSA The total cost for these courses was £699 payment was made through Pay Pal When I purchased the courses I was provided with no details about the courses at all! I was not informed that some of the courses had expiry dates, so if I knew or was even informed that this was the case I wouldn’t have purchased any courses at all from your partner/mindleaders! Mindleaders website states a 3 day cancellation period within this time I reviewed the courses and began work on the first course. During this time of studying I requested advice/ help with the course and had questions I needed answering. Unfortunately after trying to contact Mindleaders by telephone with the number that is provided on the website and that I was given, leaving many voice messages and sending many emails I finally managed to get in contact with you. Via telephone I spoke to who I thought was the manager of Mindleaders, however he then informed me that he is not part of Mindleaders that they are a separate company who buy and sell the courses from Mindleaders. I couldn’t understand this as I explained to him that login details were through Mindleader and the website is Mindleaders, nowhere on the website or emails I have received does it provide the name or contact details of any other company. He notified me that they did not have a cancellation policy however on the Mindleaders website it states that you do. I also explained to him that the support and service you were supposed to be providing me with was not satisfactory as I could not get in contact with you for support for an unreasonable length of time and was unable to make progress with the work. I requested a full refund for the courses as I was not satisfied with the service and felt that they did not uphold their agreement of support or provide me with satisfactory service, then adding to the lack of support and service I find that the information I was provided with regarding who my seller is was false. The manager absolutely refused a refund and said there is nothing he can do, that I haven’t provided him with good enough reason for a full refund and that they do not have a 3 day cancellation period. The manager was unprofessional and replied to me via email stating I should carry on with the courses and good luck with them. The service and level of support was shocking, with the request of a full refund denied I thought I should attempt to carry on with the courses as best I could, I didn’t want to lose my money and not gain any qualifications either. A few days later I went to access my courses through the normal procedure only to find that courses had been removed without any notification or reasons as to why.  COMPTIA A+ Essentials 220- 601  COMPTIA A+ Technician 220 – 602 (Removed)  CCNA 640 – 801  CCNA 640 – 802 (Removed)  MCSA (Removed) I tried to contact Mindleaders/seller many times with the number that is on their website only to find that no one answers, I constantly left voicemails and sent emails but did not receive any reply. I did manage to get in contact with someone from technical support they advised me to get in contact with my sellers as he does not have the power to change or help me in this situation. I informed him that I have been trying to get in contact with Mindleaders/seller for the past month and still trying but no one returns my calls or replies to my emails. Eventually he said he had managed to get in contact with my seller and said that someone from the company would contact me, however this has never happened. From the middle of December 2009 up to the present day I have not had any contact with Mindleaders/seller, no support, no information as to why I have had courses taken away that I have paid for. I am so frustrated and feel I simply cannot move forward and without the courses I paid for due to the unreasonable treatment I have been subjected to, lack of support, service, communication and information I wish to have a full refund as I am unable to complete the courses I initially paid for.

Social Services - Is this unethical... and what can I do...? Ok... here is the deal... I was dating a girl that worked for social services about a year and a half ago... it was good for awhile and then she cheated on me because she thought I was cheating on her... I was not... and when I found out I left her... since that time she has tried to get back with me constantly and I have said no... and then cut off all contact... The problem is... that she keeps interfering with my relationships... I have dated three girls... since then and all three of them have mysteriously disappeared on me... things were going well... and then poof gone... and I mean very well... no arguments... nothing... Well I finally found out some answers from the first girl I dated... she had a single kid... the father was not in the picture and she was not getting child support... it seems that some how social services got involved in the picture behind the scenes and started to force the issue... she had never told the father of the child about her son... and so during all of the pressure and stuff she bailed on me... Turns out the second girl that I was dating was in the same situation... her oldest child (she had two)... was from a different father... and she was not collecting child support from him and did not want him in the picture... this one I have not went back and confronted yet... but it would not suprise me if there was not a similar connection... Finally the thrid girl told me that the childs father did know about the kid when he was born but she never pushed for child support as she did not want him in the picture as well... She disappeared back in August... and now she is back... but has disappeared again... but I do not know the details... Each time that these girls disappear the girl that I dated from social services calls me about two or three days later... "Just to see how I am doing"... and the last time told me in these exact words... "You really should not date anyone for a long time... you won't keep getting hurt"... I do not know what to do... I hate to think that I brought hardship into these three ladies lives simply by dating them... and while I know a simple answer is not to date anyone else in the future that has kids or that is not getting child support is there anything that I can do... Can Social Services take it upon themselves to go after a father that does not know he even has a child for child support... what is my recourse for action... I just want this to stop... If the girl that I dated from Social Services is working within the legal limits of the law... then I am sitting here with my hands tied... but if she is abusing her authority or doing something illegal I want to know because I would burn myself to the ground to out her... He also says on manufacture of laptop the screw inside was not secure or the incident would not have happened, as we are meant to be able to open a screen without the lower half of casing popping open. Sony in my opinion have abused their power and tried to manipulate me and im not happy. • I’m also looking for compensation for the stress caused to me by the attitude of a low service and worry I was given. • Please be aware that this situation will not go away until this is resolved. Anyone have input on the ethical and legal implications of...? ...extending an invite to our son's first mother to live in our city, probably in a house we rent out? Background: Recently, we have heard from her about her failing health. It isn't good and neither is her state of mind. We have had some very disconcerting messages from her recently and know she feels lost. Today we received an email suggesting TO US some sort of joint custody arrangement because she doesn't feel she can do it alone once back in the country with her daughter, our son's full sister. This would be an opportunity for both kids to know each other, especially given that we were asked to parent her if anything happened to her or bio dad. We would not pay anything for her. She would pay rent and receive whatever assistance she would get anywhere else. Complications: Child was born overseas and may not be considered a dual citizen. Bio dad (who may not be able to come back...he was deported) may not consent to an adoption IF that ever came up so the kids would be close only to have it all ripped apart. He would never get custody HERE due to the nature of his past crimes and incarceration. First mom may be at risk of losing this girl to children's services and although we would likely be the receiving home...we don't want to interfere with ANY of that. Those chips have to fall as they will although avoiding it by supporting her would be ideal. (if bio dad makes it back to live with them...totally different opinion on that) First mom definitely needs support of an emotional kind and this could become very complicated in a negative way. We have no problems with our son knowing her, talking with her etc...but if we intertwine too much..it may interfere with parenting from both sides...at least that's a concern I currently have. So...we know that in the end, we would have to consult a lawyer before any of this is SUGGESTED to her but wondered if anyone had insight from personal experience. Doing the right thing sure is complicated...our son is the first priority (ie. safety and well-being) but it can get blurry too. We will risk our relationship with her to save the girl. And you are right about hands off support. That is a little harder though. She is our son's first mom. If we want her to succeed as a good parent NOW...having someone to count on would be the right thing. But not at the risk of hurting our son. She already asks for advice and guidance on things so the line is already blurred to a point. Being so close physically would definitely be a further tie. AARRGGHHH Don't care if it isn't "pretty". Is it really ok for them to ask for child support after they abused me? When I was five my sister and I were pulled from my divorced father on charges that he abused my sister, although he didn't we were still pulled into foster care. By the age of nine social services had denied both my mother and father custody of me (my sister ran away constantly and the social services returned her to my mother). My aunt from my fathers side decided to become my legal guardian. I was never abused by either of my mother or father and I constantly told therapists that, but despite my parents fight to get me back and my confessions, social services would not return me to either parent. My aunt took me in promising my mother constant contact (contact with my father had been denied), my aunt did not live up to that promise and within the first few months of me living with her she cut off contact between my mother and I. I had no idea. For a few months social services watched to see how things went while I lived with my aunt, everything was great, at first. After one or two months I got a call saying that my aunt was my guardian, I was used to moving around and staying with people so I was ok with it but I still loved my parents and wished to be with them. The abuse started after 2 or 3 months and lasted all 7 years I was there, mental, physical, even sexual from my uncle. My aunt physically abused me constantly and worked me hard on consistently outrageous amounts of chores. I reported them a few times but each time I was left with being sent home confused and my aunts family all telling me "What goes on in this house stays in this house". I stopped telling people by the time I was 13. When I was 16, a Sophomore in high school, a friend noticed my black eye that was from my aunt back handing me one day for not being fast enough on my chores. She reported it to the councilor at school and lets just keep it simple to say that year was the year I finally got out of that house and finally returned to my parents. Now 4 years later my parents are for the first time after the whole incident are being asked to pay child support to that family in particular.I live with my mother who is single living off a gas station pay check every month, I'm unemployed and dependent on her and I hate it but due to the abuse I have a fear of people that is a true disability to how I function. Why must my parents pay any state or person when they never abused me, when I was taken away when I wanted to stay? Is it really ok for the people who truly abused me to get paid for it- is it ok for the state who had put me in a therapists chair that never reported what I confessed to him at 11 about the abuse going on, is it ok for them to ask for this? I have met people from different places who said the social services had put them into worse places than what they came out of. -They were also very set financially they did need the extra support. I got free school lunches and my aunt always used the excuse that I wasn't hers to get any sort of help when it came to school or health, so it wasn't like she really paid to much extra from her pocket. She had 3 kids of her own but her husband was retired military, they worked for the city and state so... they never had to push to make ends meet they always had extra. They went out of their way and bought an RV camper about the time I was 14 and camped every summer after they got it. They had a pool, a house..... Really they had no issues with money and only recently has my aunt really started pushing for the payment of child support. Does anyone know if there are legal issues with false service dates for court papers? First, I live in California. I was just informed that I will be going to court for a Order to show cause (OSC). for modification of support and additional child care money. Along with a host of other useless requests from my Ex-Wife. However, the papers filed with the court show that the documents were MAILED to me on September 7. The Hearing date is October 23. But the strange part is the post mark on the Envelope is OCTOBER 14. Couple of questions: Don't I have to be rightfully served? Don't I have due process and should have the papers a full 30 days? Can I have my son's last name legally changed to mine and get sole custody since his dad is no longer involved? My ex and I were never married. We were together for 10 years and had a son together who is now 4. We haven't been together for a couple of years and we haven't heard from him for nearly a year even though he lives in the same town. I guess he decided he didn't want to be involved. I've heard from people that because we weren't married at the time of his birth I would have to file for custody. My ex signed the declaration of paternity and is on the birth certificate, however he hasn't responded to child support services and their attempts to reach him to establish a child support order. I heard he was arrested about 2 months ago for dealing/transporter marijuana. He was released on bail right away and as far as I know because it's his first offense/arrest he will likely only get a fine and maybe probation. I'm wondering if now is the time to go to court to establish custody and I wonder what the liklihood is that the court would grant me sole physical and legal custody? Would they try to get my ex involved even if he has shown a lack of interest in doing so before? If I wanted his parental rights severed would it take more than him just not coming around for a year? Would I have to prove him unfit? Would the judge make the decision or would my ex have to agree to sign his rights away? If my ex doesn't want to be involved or even pay child support I would prefer him to not have the right to come in and out of my son's life whenever he likes down the road... and also tell me if I can or cannot move, etc. I would also like my son to have my last name if I'm going to be the one raising him alone. In TN can court award me less days when my x is seeking to alter visitation due to her moving out of tn w/son? In March 2009, me and my x-girlfriend spent several hours and alot of money to finalize visitation and child support, I got 141 days of visitation, but got screwed in child support $813/month. All of that just to have her attorney send me a notification that she was getting married and moving to Hamilton, MS, I live in Memphis, with my son. I don't have an attorney but talked to legal services at Juvenile Court and was advised that the courts would allow her to move, so I decided to grant the mover and for go the $100 filing fee to try and petition against the move. My ex's attorney filed for a court dated in February to seek to alter visitation, where they are also seeking for the court to award me her court cost and attorney fees, which I'm still paying on $20,000, from the first time. So I informed her attorney that I would be representing myself and would like to settle before court, so I sent proposed new visitation, which was fair and still allowed me my 141 days, they in returned sent me a proposed plan with only 83 days of visitation. My honest opinion is that she is doing this to make me pay more child support, since tn is on an income share plan and the less days you have the more the you have to pay the other parent. Now I'm scared that since I'm representing myself the courts are going to award me less days.

court date and no money...what's going to happen? i am asking this question for a friend. she really could use some good advise. basic facts - she and her husband sepereated. after one year of seperation -he filed for divorce and is seeking custody of their 2 boys ages 2 and 3. she hired an attorney who wanted 1500 retainer. she only had 1000 but the attorney told her she could 'pay out' the other 500. first hearing was last december. they agreed upon joint custody where she would get the boys one week and he would get the boys the next week. they made the 'switch' every sunday. he was also ordered to pay her child support monthly. in the orders it stated that she would not let boys be around a certain male friend of her's because the husband did not like him and accused him of being a 'dope smoker'. the arrangement carried on over the next 4 months - even though it took 3 months before he paid the one and only child support payment. in april the husband accused her of letting the boys be around the male friend - so he would not let the boys return for her week. this is september and he has still kept the boys from the mom. even though he is not with the boys neither - they are staying with his mom. the husband is now living with a 19 year old that is expecting his baby. there is another 19 year old ex girlfriend of his that is also expecting his baby. he has the money for attorney because he is receiving benefits for a 'bad back' - not too bad that he can't run around impregnating girls.sorry. the wife paid her attorney another 400 but still owed 100. that attorney filed a motion to withdraw from the case stating lack of payment and lack of communication. she tried to communicate with him almost daily but he never returned the telephone calls and all she owed was the last 100. at the withdrawl hearing the judge asked her if she agreed to the withdrawl - she stated - yes, if he will give me my 1400 back so that i can get another attorney. the judge granted the withdrawl then turned to her and said - i can't make him give your money back. that attorney never filed one paper for her - including the paper that she had gone to parenting class as ordered. now there is a court date in a couple of weeks for the final hearing for the divorce. she has no attorney and no money for one unless the attorney will take payments. free legal services in her area declined stating not enough manpower. so the question is - what is going to happen at the hearing if she has no attorney. she is a hard working young lady but her money goes on survival - little left for an attorney - and the small town that the case is filed in - the husband's hometown - is very country and seems to be not very fair. is a young mother who has had her children kept from her for over 5 months already going to loose her children all because she is not financially capable of fighting for them. i feel the whole set up of one week for him - one week for her was a big set up for her to fail - as she could not get any kind of government aid for things such as child care while she worked because they weren't with her full time. please advise if you know of anything that might help this situation. thank you.

Churchill Car Insurance Problem? Had accident which was my fault in Nov 08, hit a van in rear that stopped suddenly going through a roundabout (less than 5mph) and his trailer hitch ball went into my radiator and damaged the hood, grill and radiator. Car was 1996 Honda in very reasonable condition, MOT'd and all in good service despite its 125,000 mileage, new tyres, exhaust, battery, and clean throughout. Had fully comprehensive insurance with £50 deductable, loaner car and legal support so paid to be protected. When car was collected from accident, collecting garage said at that time that due to the mileage my car would not be repaired. However it took 5 to 6 weeks for the insurance examiner to determine that my car was beyond repair, so I did without a car all that time. Despite repeated phone calls to them, they never called me back as their examiner was on holiday. Then when we finally agree that a price of £500 for my car in January 08 and that took some haggling, the cheque never and so I started chasing them down in early February. I am then informed that I did not disclose a speeding violation on my application and they would have to listen to the tapes of my applying to verify this. Again this took several weeks, and I again had to pursue them for an answer to which they then said I had applied on the internet so no record of a phone conversation. The internet application was misleading, asking for what I believed was 3 years worth of offenses. I've only ever had 2 speeding offenses in my entire life - both speed cameras, just over the limit. The first was at 6 a.m. and I passed a bus pulling over to stop and as I passed it got flashed. The second on the day I found my dad had days to live and I was rushing to catch a flight, and as in both instances was doing 42 mph in a 30 mph zone for a very short period. Nonetheless, I was speeding and paid my fines. I wrote to the insurance company and apologised for not telling them of the other speeding ticket from 4 years and 9 months earlier as I forgot about it. But I admitted it, and apologised in writing. Then then came back to me saying that there would be additional premium to pay before I would get paid for my car. Well, its October 08, and I finally got a letter from the insurers saying they are not paying me as I failed to pay the additional premium requested and they were not going to renew my policy. I have never been asked even after repeated letters to them how much the additional premium was, and what I should do. No replies. I have asked for my car back which they agreed to pay for, and now they state there is nothing they can do, and it is their final decision. I went to the financial ombudsman and unbelieveably DID NOT get a reply from them. I've even spoken to one of their "survey" staff who tells me that they are incredibly busy and it was probably put aside and not dealt with. I'm at a total loss as to where I stand and how to pursue this without spending more than the accident and car was worth. I've written to their data protection officer and obtained copies of all documentation pertaining to this, so by their records can verify all this information quite clearly. Finally, I maintained my cool with them at all times. Never once did I raise my voice or become unprofessional with them. My questions are: 1. Can I legally request my car back as it has never been paid for? 2. Were they taking money for policy on a car they knew that through mileage alone, they would never pay for loaner car, or to have repaired? 3. This has meant over 30 letters and more phone calls than that to deal with, and rarely do they call you back or reply at all. Can I claim for this time and distress? 4. Am I totally wasting my time? I'm trying to cancel my service, a feat I have been able to do during moves using their website. However, their website now refuses to accept a customer service request regarding an account for "security reasons." I'd say that sarcastically because attempts to send feedback using the same form and a different contact reason always results in a comment tantamount to a blow off. I've tried calling them to cancel my account 2 separate times today. Each time I am put in a phone queue. The recording tells me I am caller 9-1, then when it gets down to caller 1, I am transfered to voicemail. This is total bull! It's obvious they are making it difficult to cancel so they can keep bilking me for money. I don't want to have to cancel my credit card, but what choice do I have? Need legal advise for Child Support Services!!!!!!!!!? I currently have a case, and my daughter mother and I share Joint Custody, with her mom as the Primary/Physical. Last year her mother attempted suicide, and I basically got my daughter out of a bad situation. She has lived with me since last April, and goes to school full time. Recently I came across some hard evidence that her mother is using Methamphetamines. She doesnt know I know, and I want to modify our case so I can get full custody, and arrange some supervised visits when and if she gets cleaned up. I know of getting an emergency hearing, and have also heard I need to file an Exparte/Order to SHow cause filing. Do you know if this is accurate. How do I get affordable legal representation for child support and visitation court appearance in So. Cal.? I am a non-custodial father. In October my daughter's mother took me to court to increase child support. She lied about my daughter being in daycare and won a significant increase in support. I then hired a lawyer and took her back to court. She asked for a continuance and then missed court on the second appearance causing me to pay my lawyer over $5,000 for three court appearances. Since I had a lawyer this time the judge made a fair judgment regarding child support and transportation. The final court appearance was two months ago and she just informed me that she's taking me back to court because she decided to stop working and wants more money from me. I know that I will not receive a fair judgment if I go without representation, but I am still paying for my recent legal fees and definitely cannot afford to pay that much money again. I've been trying to research the different legal rights for someone with a emotional support animal as compared to someone with a psychiatric service animal and as I haven't had much luck, I thought I'd ask here. From what I've read the only legal right I've found listed for owners of ESAs is the right to housing in no pet apartments. Is that the only one that applies to people with ESAs? What about taking an emotional support animal on public transportation and businesses? Can you legally be denied entrance to a business if you have an ESA with you? Is it legal for a public school to give an exclusive contract to a mental health agency and deny others access I work in a school district that has an exclusive contract with a local private mental health provider. The contract allows this provider the ability to come onto any of the campuses in the school district to provide counseling and case management services to only the students who are already receiving services by the provider in the provider's clinic. Other students who are not already going to the clinic are not seen by the personnel of the provider at the school. The problem is that there are two other mental health providers who see some of our students but they are not allowed to step into the schools during the school day, even with permission from a parent. Child support and custody please help!? I have a one year old. She is the result of a 3-month relationship that I had while separated rom my husband. My husband is her legal father because we never divorced, we reunited and I was three months pregnant with the other man's child. The biological father has never made an effort to see the child, but some of his family members have. I am still married to the legal father. I am considering filing for child support services. I want to know, what the biological father would have to do to obtain visitation after he is paying support. He is a convicted felon. After we were together I found out he was on parole. I think he is in violation of parole. I also know he has a history of doing drugs. Anyway, could he get visitation with a criminal record? I heard that if there is a suspicion that your ex is misusing the child support money, you can request thru the court or a legal document, that your ex provides an expense report of how they are spending the Child Support. This has to be supported by receipts and such. Is this true, how we can get this document? Do we go thru the Child Support service?
